General Terms and Conditions (GTC)

1. Scope of Application
1.1 These General Terms and Conditions apply to all sales, deliveries and services provided by the Seller to its customers (hereinafter “Customer”).
1.2 Any deviating terms and conditions of the Customer shall only become part of the contract if expressly agreed in writing by the Seller.

2. Contract Formation
2.1 All offers are non‑binding and subject to change. A contract is concluded when the Seller confirms the Customer’s order in writing or by e‑mail.
2.2 The contract is subject to the condition precedent of full payment of the purchase price by the Customer.

3. Prices and Payment
3.1 All prices are in Swiss francs (CHF) and include statutory value‑added tax.
3.2 The Seller reserves the right to adjust prices. The prices valid at the time of order confirmation on www.neldencaviar.com shall apply.
3.3 Accepted payment methods: major credit cards (Visa, Mastercard, Amex), PostFinance, TWINT, PayPal.
3.4 In case of default in payment, the Seller is entitled to charge interest at 5 % per annum above the Swiss National Bank base rate.

4. Delivery Terms
4.1 Standard deliveries within Switzerland and Liechtenstein are made via express shipping within 24 hours after receipt of payment.
4.2 Night express deliveries (before 07:00 AM) require receipt of order between 07:00–09:00 AM and personal acceptance by the Customer at the Swiss Post office.
4.3 Delivery is free of charge. Risk passes to the Customer upon handover of the goods to the Customer or a person designated by the Customer.

5. Delivery and Billing Address
The Customer must notify the Seller of any differences between the delivery and billing address at the time of ordering. The Seller assumes no liability for misdelivery due to incorrect address details provided by the Customer.

6. Obligations of the Seller
The Seller fulfills its obligations by timely delivery of the agreed products. Place of performance for delivery and payment is the Seller’s registered office in Lugano.

7. Complaints and Returns
7.1 Obvious defects must be reported in writing to the Seller within 24 hours of receipt of the goods.
7.2 The complaint must include photos and a description of the defect. Opened products cannot be returned.
7.3 In case of a justified complaint, the Seller may choose to provide replacement goods, issue a credit note, or refund the purchase price.

8. Warranty and Liability
8.1 The statutory warranty rights apply.
8.2 Liability for indirect and consequential damages is excluded. Liability for direct damages is limited to the purchase price of the defective goods. This limitation does not apply in cases of intent or gross negligence.

9. Data Protection
9.1 The Seller processes personal data of the Customer for the purpose of contract fulfillment and payment processing in accordance with the Swiss Federal Data Protection Act (DSG).
9.2 Data will only be passed on to third parties if required for contract performance or by law. Further details can be found in our Privacy Policy at www.neldencaviar.com.

10. Governing Law and Jurisdiction
These General Terms and Conditions and all contractual relationships between the Seller and the Customer are governed exclusively by Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes is Lugano, Switzerland.
